1. Acceptance of Terms
By accessing or using the JobPlots platform at www.jobplots.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, job seekers, and dental practices who access or use the Service.
2. Description of Service
JobPlots is a digital job board and recruitment platform designed specifically for the dental industry. We connect dental practices (facilities) with dental professionals, including hygienists, dental assistants, front desk staff, dentists, and associate dentists. Our services include job postings, applicant profiles, AI-powered matching, facility directories, job alerts, and referral systems.
3. User Accounts
To access certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information to keep it accurate and complete.
- Maintain the security and confidentiality of your password and accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account or any other breach of security.
4. User Conduct
You agree not to engage in any of the following prohibited activities:
- Scraping, extracting, or indexing data from the Service for commercial purposes without our express written consent.
- Transmitting spam, chain letters, or other unsolicited communications.
- Engaging in fraudulent activities, including posting fake job listings or creating false applicant profiles.
- Impersonating another person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
- Interfering with or disrupting the Service or servers or networks connected to the Service.
5. Facility Subscriptions & Payments
Our Service is free for job seekers. For dental practices utilizing our B2B subscription services:
- Payments: Subscription fees are processed securely via Stripe. By providing payment information, you authorize us to charge the applicable fees to your designated payment method.
- Recurring Billing: Subscriptions are billed automatically on a recurring basis (monthly or annually) until canceled.
- Cancellation Policy: You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing cycle. We do not provide refunds or credits for partial billing periods.
6. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of JobPlots and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
7. User Content
By posting resumes, job listings, facility information, or other content ("User Content") to the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content in connection with providing and promoting the Service. You retain all your rights to your User Content and are solely responsible for its accuracy and legality.
8. Third-Party Services
Our Service utilizes and integrates with third-party services, including but not limited to Stripe (for payments), Google (for authentication and mapping), and Cloudinary (for media storage). Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, privacy policies, or practices of any third-party websites or services.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. JOBPLOTS EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT JOB SEEKERS WILL SECURE EMPLOYMENT OR THAT FACILITIES WILL FIND SUITABLE CANDIDATES.
10. Limitation of Liability
IN NO EVENT SHALL JOBPLOTS, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
11. Indemnification
You agree to defend, indemnify, and hold harmless JobPlots and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
12. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
14. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any material changes by posting the updated Terms on this page and updating the "Last updated" date. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
